This Privacy Policy explains how Élan Aviation LLC, doing business as Élan Aviation(collectively, “Élan Aviation,” “we,” “us,” or “our”), collects, uses, discloses, and otherwise processes personal information in connection with elanaviation.com, online quote and contact forms, email or telephone follow-up, and other online interactions that link to this policy.

Élan Aviation operates as an air charter broker. We do not own or operate aircraft, and flights are performed by properly licensed third-party air carriers. A carrier, airport, fixed-base operator, ground transportation provider, or other external service may collect information under its own privacy notice. This policy does not control the independent practices of those parties.

By using the website or providing information to us, you acknowledge the practices described here. This policy does not create contractual rights beyond those provided by applicable law.

Information you provide directly

Depending on how you interact with us, you may provide:

• name, email address, telephone number, and company or organization;
• origin, destination, preferred airports, departure and return dates, passenger count, and trip type;
• aircraft preferences, baggage details, pet information, requested amenities, and other trip requirements;
• accessibility, mobility, dietary, or other assistance requests relevant to evaluating or arranging travel;
• referral source, form responses, and the substance of correspondence or calls with us; and
• information about other passengers that you are authorized to provide for a legitimate trip request.

Please avoid including sensitive information unless it is reasonably necessary for the requested service. If a trip proceeds, additional information may be requested through trip-specific documents or by the operating carrier; those materials may be subject to additional notices.

Information collected automatically

When you use the website, browsers, devices, and supporting infrastructure may generate technical information such as IP address, browser and device type, operating system, referring URL, pages viewed, approximate location derived from IP address, access date and time, and interaction or conversion data. Cookies and similar technologies may also be used as described in our Cookie Policy.

Information received from third parties

We may receive relevant information from referral partners, marketing or analytics providers if configured, properly licensed air carriers, aircraft operators, aviation service providers, customer relationship management or form systems, publicly available sources, and other parties you authorize. The categories received depend on the relationship and may include contact details, referral information, itinerary details, carrier availability, and service-related communications.

We may use personal information for the following business and operational purposes:

• responding to inquiries and preparing, coordinating, or facilitating requested charter quotes;
• matching trip requirements with potentially suitable carriers, aircraft, airports, or service providers;
• communicating about an inquiry, requested service, itinerary change, or related customer-support matter;
• coordinating accessibility or mobility assistance identified in a request;
• operating, maintaining, troubleshooting, personalizing, and improving the website and quote experience;
• measuring performance and understanding website use when analytics tools are lawfully enabled;
• detecting fraud, abuse, security incidents, false requests, and other harmful or unlawful activity;
• maintaining appropriate business records, resolving disputes, and enforcing applicable agreements;
• complying with legal, regulatory, accounting, and reporting obligations; and
• sending marketing communications where permitted and protecting Élan Aviation, users, carriers, and others.

We may combine information collected from different sources for these purposes. Where applicable law requires consent or another specific legal basis, we will process the information in accordance with that requirement.

Charter inquiries cannot always be evaluated without sharing itinerary and passenger-related information. We may disclose relevant information to properly licensed air carriers, aircraft operators, and aviation support providers to check availability, suitability, pricing, and operational requirements or to facilitate a service you request.

We may also share information with:

• airports, fixed-base operators, ground transportation companies, caterers, and related trip-service providers as needed for the itinerary;
• hosting, infrastructure, form, customer relationship management, email, communications, analytics, and advertising providers supporting our operations;
• attorneys, accountants, insurers, auditors, and other professional advisers acting within their roles;
• courts, regulators, law enforcement, or other authorities when disclosure is required or permitted by law or reasonably necessary to protect rights and safety;
• actual or prospective participants in a financing, reorganization, merger, sale, or transfer involving all or part of the business, subject to appropriate safeguards; and
• other parties at your direction, with your consent, or as disclosed when information is collected.

We expect service providers processing information on our behalf to use it for the services they provide, subject to their contractual and legal obligations. Independent carriers and trip-service providers may determine their own processing purposes and are responsible for their own privacy practices.

Cookies and similar technologies can support strictly necessary functions, remember preferences, measure performance, or support advertising where used. The current website uses a first-party consent cookie to remember privacy choices. Optional categories remain unavailable to a script unless the visitor’s stored selection permits that category and the integration is actually registered in the code.

You can review the current registry, browser-control information, and preference options in our Cookie Policy. Blocking all cookies at the browser level may prevent the site from remembering your privacy selection.

Microsoft Clarity is registered as an analytics and session-replay provider. Its script loads only after a visitor allows the analytics category. Google Tag Manager is also installed to manage analytics and advertising tags. It receives denied consent by default and is updated only with the categories a visitor allows. Clarity may process page views, clicks, scrolling, device and browser details, approximate location derived from IP address, diagnostic information, and a masked reconstruction of page content and interactions to help us understand and improve the website.

We may use the contact details you provide to answer a question, follow up on a quote request, obtain missing itinerary information, or communicate about a requested trip. These service-related messages are connected to the interaction you initiated and are distinct from general marketing communications.

Where permitted, we may send promotional email. You may use the unsubscribe instructions in a marketing message or contact us to request removal from marketing lists. Opting out of marketing will not prevent a necessary response to an active trip request, a transaction-related communication, or a legally required notice. Telephone and text-message practices must follow the consent language presented at the point of collection.

We retain personal information for as long as reasonably necessary for the purpose for which it was collected and for legitimate operational, legal, accounting, fraud-prevention, security, and dispute-resolution needs. Relevant factors include whether an inquiry remains active, whether a charter was arranged, the nature and sensitivity of the information, contractual recordkeeping duties, and applicable limitation periods.

Retention periods may differ by record type and system. Information may be deleted, deidentified, or aggregated when it is no longer reasonably needed, subject to backup cycles and legal holds. Élan Aviation will not publish a precise retention schedule until operational practices and vendor settings have been confirmed.

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure, taking into account the nature of the information and the context in which it is processed. Access and safeguards may also depend on the systems and service providers used to support a request.

No online transmission, storage system, or security measure can be guaranteed completely secure. Please use care when sending sensitive information and contact us if you believe your interaction with Élan Aviation is no longer secure. This policy does not claim a certification, encryption standard, or security framework that has not been independently confirmed.

Depending on where you live and whether a particular law applies to Élan Aviation or its processing, you may have rights to request access to, correction of, deletion of, or a portable copy of certain personal information. You may also have rights to limit or opt out of certain processing, such as targeted advertising, sale, or qualifying sharing, and to appeal a decision on a request. Exceptions and verification requirements may apply.

To submit a request, email legal@elanaviation.com with the subject “Privacy Request” and describe the right you wish to exercise. We may ask for information reasonably necessary to verify identity and protect against fraudulent requests. We will use verification information only for appropriate request-processing purposes.

Where permitted, an authorized agent may submit a request. We may require proof of authority and, where allowed, confirmation directly from the consumer. We will respond within the period required by applicable law and will explain any lawful reason we cannot fulfill all or part of a verified request. We will not unlawfully discriminate against a person for exercising an applicable privacy right.

Élan Aviation is based in Florida. Certain Florida residents may have privacy rights when an applicable Florida privacy law covers both the individual and Élan Aviation’s activities. The availability of a right depends on the law’s definitions, exclusions, and business thresholds; this policy does not represent that the Florida Digital Bill of Rights necessarily applies. Florida residents may use the request process in the preceding section, and we will evaluate the request under the law that applies to the circumstances.

Residents of California and other states may receive additional rights if a state privacy law applies. These may include rights concerning sale of personal information, sharing for cross-context behavioral advertising, or targeted advertising. Whether those concepts apply depends on the technologies, disclosures, relationships, and statutory thresholds in effect at the relevant time.

Élan Aviation has not yet completed the business and vendor audit needed to state categorically whether personal information is “sold” or “shared” under every state law. We therefore do not make a blanket claim either way. The current application contains Microsoft Clarity analytics but no registered advertising or targeting technology. Visitors can allow, reject, or withdraw Clarity analytics through the site’s Cookie Preferences. If practices change, the site must add any additional control required before corresponding claims are published.

The website is not directed to children under 13, and we do not knowingly invite them to submit information directly. A parent, guardian, or other authorized adult may provide information about a child passenger when reasonably necessary for a legitimate trip request, such as age-related carrier requirements, seating, documentation, or assistance needs. If you believe a child submitted information without appropriate authorization, contact us so we can evaluate and take appropriate action.

Élan Aviation is based in the United States. If you access the site from another country or request international travel, information may be transferred to and processed in the United States and in countries relevant to the requested itinerary, where privacy laws may differ from those in your location.

International visitors may have rights under local law, subject to that law’s scope, exemptions, and available transfer mechanisms. Contact us to make a request. This policy does not claim comprehensive compliance with the General Data Protection Regulation or another international regime without the supporting operational processes.

The website may link to airport, weather, destination, regulatory, carrier, mapping, or other third-party sites and services. A link does not mean Élan Aviation controls the third party’s data practices. Information you provide to or that is collected by a third party is governed by that party’s own terms and privacy notice. Review those notices before providing information.

We may update this policy to reflect changes in the website, quote workflow, vendors, law, or business practices. The “Last updated” date identifies the current draft. If a change materially affects cookie consent, we will increase the consent version so visitors are asked to make a new choice. Additional notice will be provided when required by law.
